Current legislation opposed by REBA6/19/2008REBA has contacted the Chair of the House Committee on Bills in Third Reading to oppose two bills. First, H. 1770 would severely restrict the eminent domain power of a municipality in Massachusetts. The legislation is an over-reaction to a 2005 decision of the Supreme Court of the United States, Kelo vs. City of New London. A second bill, H. 2990, would reverse a 2001 SJC decision, Town of Milford vs. Boyd, permitting municipalities to stop paying condominium common charges following a tax taking. This legislation, if enacted, would create major burdens and financial instability for condominium owners associations, particularly in smaller condominiums.
