Current legislation opposed by REBA

REBA has contacted the Chair of the House Committee on Bills in Third Reading to oppose two bills. First, H. 1770 would severely restrict the eminent domain power of a municipality in Massachusetts. The legislation is an over-reaction to a 2005 decision of the Supreme Court of the United States, Kelo vs. City of New London. A second bill, H. 2990, would reverse a 2001 SJC decision, Town of Milford vs. Boyd, permitting municipalities to stop paying condominium common charges following a tax taking. This legislation, if enacted, would create major burdens and financial instability for condominium owners associations, particularly in smaller condominiums.
